Terms and Conditions

Effective Date and Acceptance

These Terms and Conditions (“Terms”) are effective as of July 22, 2026 and govern your access to and use of the website located at https://holyokecannabis.com (the “Site”) operated by Holyoke Cannabis, Inc. (“Holyoke Cannabis,” “we,” “us,” or “our”). By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

Age Requirement (21 and Older Only)

Holyoke Cannabis is a licensed adult-use cannabis retailer in the Commonwealth of Massachusetts. You must be twenty-one (21) years of age or older to access the Site, browse product information, place orders, or visit our physical dispensary. By using the Site, you represent and warrant that you are at least 21 years of age and are legally permitted to purchase and possess cannabis products under Massachusetts law.

Valid, government-issued photo identification is required at every in-store pickup or purchase, and may be verified at any time during your interaction with the Site or our dispensary. We reserve the right to refuse service to any person who cannot provide valid proof of age.

No Medical or Therapeutic Claims

Holyoke Cannabis is an adult-use (recreational) retailer, not a medical cannabis provider. Nothing on this Site is intended as, or should be construed as, medical advice, diagnosis, or treatment. Cannabis products offered on this Site have not been evaluated or approved by the U.S. Food and Drug Administration (FDA) for the treatment, cure, mitigation, or prevention of any disease or health condition.

Information on the Site regarding strain characteristics, effects, cannabinoid or terpene content, or customer experiences is for general educational purposes only. Individual responses to cannabis vary. Consult a qualified healthcare provider before using cannabis, particularly if you are pregnant, breastfeeding, planning to become pregnant, taking prescription medications, or have any pre-existing medical condition.

Required Massachusetts Consumer Warnings

As required by the Massachusetts Cannabis Control Commission (“CCC”) under 935 CMR 500.000 et seq., the following warnings apply to all cannabis products sold by Holyoke Cannabis:

  • This product has intoxicating effects and may be habit forming.
  • Cannabis can impair concentration, coordination, and judgment. Do not operate a vehicle or machinery under the influence of this product.
  • There may be health risks associated with the consumption of this product.
  • For use only by adults twenty-one (21) years of age or older. Keep out of the reach of children and pets.
  • There may be additional health risks associated with the consumption of this product for women who are pregnant, breastfeeding, or planning on becoming pregnant.
  • Marijuana products may be purchased or possessed only by persons twenty-one (21) years of age or older. Possessing, using, distributing, and selling marijuana remains illegal under federal law.

Product Availability, Pricing, and Menu

All product listings, menus, pricing, and promotional offers on the Site or via our third-party menu partner (Dutchie) are subject to change without notice and are not guaranteed. Product availability is limited to in-store inventory and may vary. Prices displayed do not include applicable Massachusetts state and local taxes, which will be calculated at the point of sale.

We reserve the right to correct pricing errors, refuse or cancel any order for any lawful reason, limit quantities, discontinue products, and modify or remove promotions at any time. Product descriptions, potency figures, and cannabinoid content displayed on the Site are provided by cultivators and testing laboratories and are believed accurate at time of listing.

Ordering, Pickup, and Payment

All orders placed through the Site or Dutchie menu are for in-store pickup only at our licensed Holyoke, Massachusetts location. Delivery is not offered. We do not ship cannabis products. Cannabis products may not lawfully be transported across state lines under federal law.

All customers must present valid government-issued photo identification proving they are 21 years of age or older at the time of pickup. Orders will not be released without proper identification. Unclaimed orders may be canceled and restocked at our discretion.

Payment is due at the time of pickup. Due to federal banking restrictions on cannabis businesses, accepted payment methods may vary and are subject to change. Current accepted methods will be displayed at checkout and in-store.

Massachusetts Cannabis Compliance

Holyoke Cannabis operates under license issued by the Massachusetts Cannabis Control Commission pursuant to 935 CMR 500.000. All transactions, product handling, packaging, testing, and record-keeping are conducted in accordance with applicable Massachusetts law and CCC regulations. By purchasing cannabis products from Holyoke Cannabis, you agree to comply with all state possession limits and consumption restrictions, including but not limited to:

  • Possession limit: up to one (1) ounce of cannabis flower on your person, or up to ten (10) ounces stored in a primary residence.
  • Consumption of cannabis in public places, on federal property, or while operating a motor vehicle is prohibited.
  • Transporting cannabis across state lines is a federal offense.
  • Providing, gifting, or selling cannabis to any person under 21 is prohibited and subject to criminal penalties.

Prohibited Uses of the Site

You agree not to use the Site to:

  • Violate any applicable federal, state, or local law, regulation, or CCC rule.
  • Purchase products on behalf of, or divert products to, any person under 21 years of age.
  • Misrepresent your age, identity, or eligibility.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Site, our servers, or our networks.
  • Use automated systems (bots, scrapers, crawlers) to access the Site or collect product, pricing, or customer information.
  • Transmit any virus, malware, or other harmful code.
  • Reproduce, resell, or redistribute any content from the Site without our prior written permission.
  • Post, upload, or transmit any content that is defamatory, harassing, obscene, or otherwise unlawful.

Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, product images, photographs, videos, page layouts, and the “Holyoke Cannabis” name and marks — is the property of Holyoke Cannabis or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, republish, upload, post, transmit, or distribute any Site content in any way without our express prior written consent.

User Content and Reviews

If you submit reviews, comments, testimonials, or other content to the Site or to third-party review platforms linked from the Site, you grant Holyoke Cannabis a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, publish, distribute, and display such content in connection with our business. You represent that any content you submit is your own original work, does not violate the rights of any third party, and complies with these Terms.

We reserve the right to review, edit, or remove any user-submitted content at our sole discretion. In accordance with CCC rules, we do not solicit or publish reviews that make medical or therapeutic claims.

Third-Party Links and Services

The Site may contain links to third-party websites and services, including our online menu partner (Dutchie), payment processors, analytics providers, and social media platforms. Such links are provided for your convenience only. Holyoke Cannabis does not control and is not responsible for the content, privacy practices, or terms of any third-party site or service. Your interactions with any third-party site are governed by that site’s own terms and policies.

Disclaimer of Warranties

THE SITE, ITS CONTENT, AND ALL PRODUCT INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. HOLYOKE CANNABIS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY PRODUCT INFORMATION IS COMPLETE OR CURRENT.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOLYOKE CANNABIS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCTS PURCHASED, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HOLYOKE CANNABIS IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

Indemnification

You agree to defend, indemnify, and hold harmless Holyoke Cannabis and its officers, directors, employees, affiliates, and agents from and against any claim, demand, action, loss, liability, damage, or expense (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, your violation of any applicable law or regulation, or your violation of any right of a third party.

Governing Law and Jurisdiction

These Terms and any dispute arising out of or related to them or your use of the Site shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Hampden County, Massachusetts for the resolution of any dispute.

Changes to These Terms

We may revise these Terms at any time by posting the updated version on the Site. Material changes will be indicated by updating the “Effective Date” at the top of these Terms. Your continued use of the Site after any such change constitutes your acceptance of the revised Terms. If you do not agree to any revision, you must stop using the Site.

Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified only to the extent necessary to make it valid and enforceable, and all remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Holyoke Cannabis regarding your use of the Site.
